Since this is something we will be hearing about for a while, we might as well know what it is.

So, here it is

As originally written in 1799, the Logan Act details the fine and/or imprisonment of unauthorized citizens who negotiate with foreign governments having a dispute with the United States, and it was intended to prevent the undermining of the government’s position.

There was a pending war with France that John Adams later proved to have been successfully working to avoid.

Charles Cotesworth Pinckney, John Marshall, and Eldridge Gerry, had been sent to France in July 1797 to negotiate in order to avoid a war. They were approached informally, and before the actual negotiations began, by agents of the French Foreign Minister Talleyrand demanding bribes and a loan before formal negotiations could begin. This was so offensive to the Americans that Pinckney and Marshall left France without ever engaging in formal negotiations, while Gerry remained and laid the groundwork for the eventual end to diplomatic and military hostilities.

Because John Adams did not reveal the names of the French agents in public papers, this became known as the XYZ Affair

In the meantime, Dr. George Logan, a pacifist unaware of the progress Eldridge Gerry had made, complicated things by going to France as a private citizen and telling the French that propagandists in the United States were portraying the French as corrupt and anxious for war, and were stating that any friend of France was an enemy of the United States.

The appearance that he had been successful where others had failed, including Gerry and Adams, riled up the emerging opposition parties, the Federalist Party and the Democratic-Republican Party, as one resented that because of his allegiance one party was getting the credit while the other was not.

Secretary of State Timothy Pickering suggested that Congress

 “act to curb the temerity and impudence of individuals affecting to interfere in public affairs between France and the United States.”

This resulted in the Logan Act, in spite of which Logan later went to England in 1810 as a private emissary of peace, but failed and we had the War of 1812.

The Act was last amended in 1994, and a violation is a felony.

The reason the Logan Act is in the news now is because on December 29, 2016, then President-elect Trump’s pick for national security adviser, retired lieutenant general Michael Flynn, spoke with Russian ambassador Sergey Kislak on the same day that the Obama administration announced retaliatory measures in the form of sanctions in response to Russia’s involvement in the hacking that took place in the 2016 presidential campaign.

The concern around Flynn’s action was suspicion that Flynn might have violated the Logan Act with those conversations.

Flynn has resigned his post as national security advisor, or maybe he was fired. It seems the terms “resigned” and “let go” are as interchangeable as “it’s not a Muslim ban” and “it’s a ban that bans Muslims”.

In spite of calls to have him investigated for violating the Logan Act, unlike the importance of investigating who used which server when sending and receiving emails, the Republicans are reluctant to do a serious investigation.

Trump was told about the complications and possible violation of the Logan Act first back in December and again in January, but claims it only came up just before the resignation this week.

And very questionable is that no one seems concerned about what Flynn may have told the Russians, or what deals were promised, the motivation for the resignation/firing is that he lied to Vice President Pence, an offense not as severe as violating the Logan Act.

“The evolving and eroding level of trust as a result of this situation and a series of other questionable instances is what led the president to ask for Gen. Flynn’s resignation,” press secretary Sean Spicer told reporters.

So now that I reread that, it seems Flynn was told to resign, and submitted the requested resignation which was accepted as if it was his idea based on some lofty principle.

I’m sure it will all be straightened out in the investigation that will not happen.
