And to show he is a better friend of the GLBT Community than anyone else, he went on to say,

 “They want to kill — they throw them off buildings. They actually throw gays off buildings. I’m much better for women than she is. I’m much better for the gays.”

The country of Brunei has introduced death by stoning as a punishment for gay sex as part of its implementing the Islamic legal system of Sharia.

Until April 3, although Homosexuality has been illegal in Brunei for decades and was punishable by prison sentences, it will now result in stoning in the presence of witnesses.

Amnesty International urged Brunei to “immediately halt” the new penalties, and researcher Rachel Chhoa-Howard has said,

“To legalize such cruel and inhuman penalties is appalling of itself. She added that some of the offenses “should not even be deemed crimes at all, including consensual sex between adults of the same gender.”

This is clearly an example of GLBT people being subjected to “the violence and oppression of a hateful foreign ideology.”

In response the State Department has said,

 “Governments have an obligation to ensure that all people, including LGBTI people, can freely enjoy the universal human rights and fundamental freedoms to which they are entitled. We strongly oppose human rights violations and abuses against LGBTI persons, including violence, the criminalization of LGBTI status or conduct, and serious forms of discrimination.”

Mike Pompeo, the U.S. secretary of state, and the State Department have declined to directly condemn the new law merely saying they are “concerned”, but being concerned is not doing “everything in my power to protect our LGBT citizens from the violence and oppression of a hateful foreign ideology.”

When pressed for further comment, perhaps a statement directly addressing the new law, the State Department sent the following statement,

“The United States is concerned with Brunei’s decision to implement Phases Two and Three of the Sharia Penal Code. Some of the punishments in the law appear inconsistent with international human rights obligations, including with respect to torture or other cruel, inhuman or degrading treatment or punishment.

“We have encouraged Brunei to ratify and implement the United Nations Convention Against Torture, which it signed in 2015, and to sign, ratify, and implement the International Covenant on Civil and Political Rights.”

Stoning, that prolonged application of pain and discomfort to either punish or get information, is not torture. Stoning is killing someone by throwing rocks at them. It may take a while, but it is not a repeated act followed by moments of rest, but a single and final act.

Referencing the ICCPR may sound good, but it must be remembered that, although the United States joined in the ratification of the United Nations resolution, it has not moved to conform domestic law to the minimum human rights standards as established in the Covenant and in the Universal Declaration of Human Rights over the last thirty years.

Britain and the European Union have condemned the new law.

But the president’s meaning of doing “everything in my power to protect our LGBT citizens from the violence and oppression of a hateful foreign ideology” seems to amount to nothing more than clicking his tongue.
