Clarence Thomas has stated the obvious, that because of the results of common sense federal laws against the use or cultivation of Marijuana may no longer make sense, after SCOTUS chose not to hear the appeal of a Colorado medical marijuana dispensary that was denied federal tax breaks that other businesses are allowed, like bakeries that refuse to follow laws on discrimination and refuse to bake wedding cakes for same sex couples based solely on membership in a church.

Thomas believes the Supreme Court’s 2005 ruling that upheld federal laws making marijuana possession illegal may now be out of date.
